Terms of Use

These Terms of Use apply to the BrightKin website and the BrightKin iOS app, including premium features made available through the App Store.

1. Agreement and scope

By accessing the BrightKin website, downloading the app, or using any BrightKin feature, you agree to these Terms of Use. If you do not agree, do not use the service.

These terms apply to the public website, the iOS app, support interactions, and premium or subscription features offered by BrightKin. They are intended to work alongside App Store requirements and other mandatory consumer laws that may apply where you live.

2. Eligibility and family use

You may use BrightKin only if you can form a binding agreement under applicable law and you are authorized to use the Apple device, Apple account, and payment method connected to your use. If you store information about a child, dependent, or other family member, you represent that you are authorized to manage that information.

3. Medical and emergency disclaimer

BrightKin is an organizational tool. It is not a doctor, clinic, hospital, insurer, pharmacist, emergency service, or medical device. Content on the website and in the app is for informational and record-management purposes only. It does not replace medical advice, diagnosis, treatment, or emergency care.

Always seek guidance from a qualified clinician for medical questions. Do not rely on BrightKin for emergency or time-critical care decisions. Vaccine records, reminders, exports, and travel-related information may be helpful, but they may not be complete, official, or accepted by every school, border authority, insurer, clinic, or other institution.

4. App license and App Store terms

The BrightKin app is licensed, not sold, to you. Subject to these terms and any applicable App Store rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, including through Family Sharing or similar Apple-authorized access where permitted.

If you downloaded the app from Apple's App Store, you acknowledge that:

  • these terms are between you and BrightKin, not between you and Apple;
  • Apple is not responsible for the app, its content, maintenance, or support;
  • Apple has no obligation to furnish maintenance or support services for the app, except as required by applicable law;
  • to the maximum extent permitted by law, Apple has no warranty obligations for the app, and if the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the app under Apple's policies;
  • BrightKin, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, privacy, consumer protection, and intellectual property claims; and
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them, Apple will have the right to enforce them against you as a third-party beneficiary.

You must also comply with Apple's applicable usage rules and third-party agreements when using the app, including your Apple Media Services terms, wireless data agreement, and any third-party platform rules that apply to your use.

5. Purchases, subscriptions, and billing

Some BrightKin features may require a paid subscription or in-app purchase. If you purchase through the App Store, Apple handles billing using your App Store account and payment method. Pricing, billing cycles, free-trial offers, renewals, refunds, and cancellation rights are also subject to Apple's rules and the mandatory consumer laws that apply to you.

Unless you cancel through Apple before renewal, subscriptions may renew automatically under Apple's billing flow. You can manage or cancel subscriptions and restore eligible purchases through your Apple account and the app's purchase-management features.

6. Your responsibilities

You are responsible for:

  • keeping your device, Apple account, passcode, and security settings protected;
  • making sure the information you enter is lawful and that you are authorized to enter it;
  • checking exported records before relying on them for school, travel, daycare, or other submissions;
  • using current app and operating system versions where reasonably available; and
  • contacting us if you believe the app is malfunctioning or a security issue exists.

7. Acceptable use restrictions

You agree not to:

  • use BrightKin in violation of law, regulation, or another person's rights;
  • interfere with the website, app, infrastructure, or other users;
  • copy, scrape, frame, mirror, redistribute, or exploit the service beyond what applicable law allows;
  • reverse engineer, decompile, disassemble, or attempt to derive source code from the app except where mandatory law allows it;
  • circumvent paywalls, security controls, feature limits, or usage restrictions;
  • upload malicious code, automated abuse traffic, or harmful content; or
  • use BrightKin in connection with prohibited export, sanctions, or embargo violations.

8. Content, records, and exports

You keep responsibility for the information and materials you choose to enter or import into BrightKin. You grant us and our service providers the limited rights needed to host, process, sync, display, back up, export, and support that information solely to operate the service.

You are responsible for reviewing your own records. BrightKin does not independently verify every vaccine entry, scan result, reminder, provider field, attachment, or travel-related detail. Generated PDFs and proof documents are based on user-entered or user-imported information and may not be official medical records.

9. Intellectual property

BrightKin, its app, website design, branding, copy, software, and related materials are protected by intellectual property laws and belong to us or our licensors unless otherwise stated. These terms do not transfer ownership to you. All rights not expressly granted are reserved.

If you send us feedback, suggestions, or product ideas, you allow us to use them without restriction or compensation, provided we do not use your feedback in a way that violates our Privacy Policy or applicable law.

10. Third-party services and links

BrightKin may depend on or link to third-party services such as Apple App Store, Apple iCloud, website hosting, analytics tools, or subscription infrastructure. Those services are governed by their own terms and privacy notices. We are not responsible for the content, availability, or independent practices of third-party services we do not control.

11. Changes, suspension, and termination

We may update, improve, restrict, suspend, or discontinue all or part of BrightKin when reasonably necessary for product, legal, security, operational, or business reasons. We may also suspend or terminate access if you materially violate these terms or use the service in a harmful or unlawful way.

You may stop using BrightKin at any time. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, Apple-specific clauses, and dispute-related provisions, will continue to apply.

12. Disclaimer of warranties

To the maximum extent permitted by law, BrightKin is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, perfect OCR or scan accuracy, successful sync at all times, or that every school, clinic, or authority will accept records produced through the app.

Where local law gives you non-waivable rights or guarantees, those rights still apply. Nothing in these terms is meant to take away mandatory consumer protections that cannot lawfully be limited.

13. Limitation of liability

To the maximum extent permitted by law, BrightKin will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, use, or data arising from or related to your use of the service.

To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to BrightKin will not exceed the greater of the amount you paid us for the applicable paid feature in the 12 months before the claim or fifty U.S. dollars (USD $50). This limitation does not apply where prohibited by law, including for liabilities that cannot be limited under applicable consumer or personal injury laws.

14. Export and sanctions compliance

You represent and warrant that you are not located in a country or territory subject to applicable U.S. embargoes and are not on a U.S. government list of prohibited or restricted parties. You may not use or export the app in violation of applicable export-control or sanctions laws.

15. Changes to these terms

We may update these terms from time to time. When we do, we will post the updated version on this page and revise the date above. If a change is material, we may also provide additional notice in the app or on the website.
